Tate was the manager of a halfway house on Beverly Lane in central Everett. On December 2, 2015, after a night of using methamphetamine, he brutally raped and murdered 30-year-old Daniel B. Dubeau who was a resident of the halfway house. A day after the murder Tate turned himself in to Everett Police, confessed to the crime and entered a guilty plea at his arraignment.
Judge Wynne acknowledged the number of letters he’s received from Dubeau’s family and friends. Dubeau’s sister and father also spoke directly to the court of their loss and the damage done to their family.Kenny Tate was given a chance to speak to the court. As he started to speak he broke down in tears and sobbed for a couple of minutes. He then spoke. “I don’t know how it happened,” Tate said. “It just happened out of nowhere and I’m still confused, I have remorse, I feel so bad for this family I really do…I’d take the death penalty…I’m so sorry.”
In addition to first degree murder, the crime also contained elements of sexual motivation and use of a deadly weapon. That meant today’s sentence was considered indeterminate which means Tate will have to appear before a special board who could make him serve the rest of his life behind bars. The 30 years handed down today is the minimum (less time for good behavior) amount of time he will serve in prison. The judge agreed to the joint recommendation of the prosecutor and defense which was at the high end of the sentencing range.
The halfway house has been evicted from the Beverly Lane property.
