According to a police report and an Everett Police detective’s testimony at the probable cause hearing, the victim was asleep in his bed when he was struck by gunfire after the suspect fired four separate shots from a shotgun through a closet and a common wall between two apartments early Wednesday morning.
The victim’s friend called Sno911 reporting the shooting and upon their arrival Everett Police rushed then victim out of the apartment and to a waiting medic unit who transported him to the hospital where he was pronounced dead from his injuries.
The suspect’s defense attorney argued the suspect had no idea where the victim was behind the common wall of the two apartments and it may have been an accidental discharge or manslaughter but did not rise to a level of 2nd degree murder.
The judge disagreed, granting the million dollar bail and ordering the suspect to surrender all of his weapons and concealed weapons permit. She also granted no contact orders between the suspect and victim’s family and witnesses. She also ordered a mental evaluation on the suspect before any release if he is able to make bail.
The Snohomish County Prosecutor now has three days to file formal charges.
MyEverettNews.com is not naming the suspect as formal charges have not been filed. The Snohomish County Medical Examiner will release the identity of the victim and cause and manner of death.
